"ALLEGATION IS DENIED. IN CROSS PETITION FILED BY JACOB HOUFSTATER WHO CLAIMS HE IS NOT A LUNATIC. ASKS ACCOUNTING OF MONEY. Says He Paid Over $3,600 Toward Building House in Shelby -- Claims His Daughter and Son-in-Law Filed Petition to Annoy and Harass Defendant. Jacob P. HOUFSTATER has file an answer and cross petition in common pleas court in the case of Albert M. YOUNG vs. Jacob HOUFSTATER and Eva R. YOUNG. The defendant admits he has a legal right to the undivided one-half of the real estate described in the petition of the plaintiff and is a tenant in common with the plaintiff in said premises. Further answering defendant says he denies the allegation made in said petition, to-wit, that he is a lunatic and that there is an application for the appointment of a guardian for him now pending in this court, but avers the fact to be that Elva R. YOUNG who is the daughter of Jacob P. HOUFSTATER and the wife of Albert M. YOUNG, the plaintiff, made application for the appointment of a guardian in the probate court of this county; that Albert M. YOUNG together with his wife, sought in that action to convince the court that this defendant was a lunatic and was very much in need of a guardian; that after a long fight the court decided that the defendant was not a lunatic but was sane and perfectly competent to transact business and take care of all his property. HOUFSTATER say the petition was dismissed. HOUFSTATER avers that is is true the plaintiff, together with his wife, gave notice of appeal and did appeal said cause to the court of common pleas and this defendant avers that he is ready and willing at any time to show that he is not a lunatic and that this allegation is to harass, embarrass and humiliate the defendant for the purposes of taking advantage of him for no other purpose. By the way of cross petition the defendant alleges that the house in Shelby described in plaintiff's petition is a double house and was built jointly by plaintiff and this answering defendant; that at the time said house was built this answering defendant was having serious trouble with his eyes; that he was unable by reason of the condition of his eyes to keep an accurate account of his investment in said house and that he depended upon the plaintiff, Albert M. YOUNG, to keep an accurate account of all accounts of money invested in said house, but that he has invested more than $3,600 in said property, the exact amount he is unable to determine until he has an accurate accounting from Albert M. YOUNG and Elva R. YOUNG, which he has requested and which has been refused. Plaintiff prays that when partition is allowed of this property that the money may be brought into court and that an accounting may be made to this defendant and fair division may be made of the money arising from the sale of this property. Skiles, Green + Skiles are his attorney."

"JACOB P. HOUFSTATER is a grandson of Adam HOUFSTATER, who was the pioneer of the family in America. Adam HOUFSTATER was born in 1755, in Germany, whence when a youth he came to the United States, and settling in Pennsylvania he learned the weaver's trade, at which he worked until he became a farmer. He was married in Pennsylvania, and moved some time later to Niagara county, N. Y., where most of the following named children were born to them; Adam, Philip, John, George, Jacob, Jane, Susan and Polly, all now deceased. George HOUFSTATER, father of the subject, was born in 1797, in Pennsylvania, accompanied his parents to Niagara county, N. Y., when a boy, and was reared on the frontier. In New York State he met Elizabeth BARRE, also a native of Pennsylvania, to whom he was wedded, and after his marriage he began farming. Seven children were born to them on the homestead, namely: Almira, Mary, David, Matilda and Fidelia (twins), Jacob and Catherine; Lucy Ann, the eighth child, was born in Huron county, Ohio, October 15, 1836. In 1836 the family moved to Ohio, and settled on the farm which is now the property of Jacob P. HOUFSTATER, which territory was then a complete wilderness. While the new comers were surrounded by neighbors, the particular land selected was still in the forest, and the clearing of this tract devolved on the father and sons. He subsequently bought a farm of 186 acres, which he saw cleared before his death in 1874. Of a hard-working, economical disposition, he left a valuable property to his children, and died with success stamped upon his work. Prior to 1856 he was a Whig, and from that time until his death a Republican. In religion he affiliated with the Christian Church. Jacob P. HOUFSTATER was born January 17, 1830, in Niagara county, N. Y. In 1836 he accompanied his parents to Ohio, where, February 16, 1854, he married Roena M. CARPENTER, of Fairfield township, Huron county. The young couple at once entered farm life, and for forty years have continued to follow it successfully. Not only does Mr. HOUFSTATER own 130 acres of improved land in Ripley township, but he has also endowed three of his children most liberally, giving to each two thousand dollars. Of their children, Cora married Agnew WELCH, editor of the Record, at Ada, Ohio; Elva married Albert YOUNG, a farmer of Ripley township; and Carrie married Edward L. YOUNG, who was city editor of the Huron County Chronicle, at Norwalk from 1885 to 1892, when he was appointed Great Record Keeper of the Knights of Maccabees. Mr. HOUFSTATER is a Republican, an active member of the party, serving his township as justice of the peace and in various other offices. He was a member of the Christian Church of Ripley, and a citizen of acknowledged worth."
