"STATE OF MICHIGAN – County of Lapeer, – At a session of the Probate court for the county of Lapeer, holden at the Probate office, in the village of Lapeer, on Monday the 5th day of July A. D. 1858, Present, Charles KELLOGG, Judge of Probate. In the matter of the estate of Betsey E. SMITH deceased. On reading and filing the petition, duly verified by Americus C. SMITH, praying that administration of said estate may be granted to John C. HINCKE of said county. Thereupon it is ordered, that Monday, the 2nd day of August next, at two o’clock in the afternoon, be assigned for the hearing of said petition, and that the heirs at law of said deceased, and all other persons interested in said estate, are required to appear at a session of said court, then to be holden at the Probate office in the village of Lapeer, and show cause, if any there be, why the prayer of the petitioner should not be granted; and it is further ordered, that said petitioner give notice to the persons interested in said estate, of the pendency of said petition and the hearing thereof, by causing a copy of this order to be published in the Lapeer Republican, a newspaper printed and circulated in said county of Lapeer, three successive weeks previous to said day of hearing. "To the Hon. Chas KELLOG Judge of Probate for the County of Lapeer in the State of Michigan: The Petition of Americus C. SMITH who is of the age of twenty-one years and upwards, of the county of Lapeer respectfully shows: That Betsey E. SMITH late of Almont in said County of Lapeer departed this life in the town of Massillon, State of Iowa on the first day of October in the year of our Lord one thousand eight hundred and fifty seven, not leaving any last Will and Testament, as your petitioner is informed and verily believes"
"That said deceased was, at immediately previous to her death [was in the] State of Iowa and that she was possessed of Personal Estate, situate and being in the County of Lapeer to be administered, and that the estimated value thereof is the sum of three hundred dollars or thereabouts, as your petitioner is informed and verily believes. And your petition, further shews that the names and residences of the heirs at law of said deceased, and other persons interested in her estate, are as follows: Myron M. SMITH, Mary Jane BALLOU, Frazee A. SMITH, Abigail P. SWAN, Sylva Ann ANDREW, Harrison SMITH, Caroline SMITH, Harriet SMITH; children of said deceased residing in the State of Iowa.” And also Stephen SMITH – Late husband of said deceased and your petitioner a son of said deceased in said county of Lapeer.""
"Your petitioner, therefore prays that all persons interested in said estate may be duly cited as required by law, and as to this Court may seem proper, that administration of said estate may be granted to John C. HINCKE of said County and that such other and further orders and proceedings may be had in the premises as may be required by the statutes in such case made and provided. Dated June 28th 1858. - Americus C. SMITH."
