{"id":12782,"date":"2013-03-07T19:51:09","date_gmt":"2013-03-08T00:51:09","guid":{"rendered":"http:\/\/www.howderfamily.com\/blog\/?p=12782"},"modified":"2022-05-11T17:53:36","modified_gmt":"2022-05-11T22:53:36","slug":"country-club-dispute","status":"publish","type":"post","link":"https:\/\/www.howderfamily.com\/blog\/country-club-dispute\/","title":{"rendered":"The Country Club Dispute"},"content":{"rendered":"\n<p>The Country Club Dispute came up from time-to-time in reader comments over the years. It&#8217;s one of those situations I&#8217;ve known about for awhile. Nonetheless, I placed in my pile of unused topics, and finally summoned enough motivation to write about today. It sounds like two snobby gentlemen with upturned noses and green blazers whacking each other with 5 irons after learning they&#8217;re dating the same debutante. That&#8217;s what comes to mind every time I spot a passing reference to the Country Club Dispute. It never fails to bring a little chuckle to my lips. Yes, I&#8217;m fully aware of the disconnect between reality and stereotype but I don&#8217;t care.<\/p>\n\n\n\n<p>It&#8217;s the reason why Texas and New Mexico have such a seemingly haphazard border northwest of El Paso. It also accounts for the only part of Texas on the &#8220;wrong&#8221; side of the Rio Grande River.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Basis of the Dispute<\/h2>\n\n\n\n<p><iframe loading=\"lazy\" src=\"https:\/\/www.google.com\/maps\/d\/embed?mid=1M1PsEK--sauMnzfN293CZjjvbS8\" width=\"640\" height=\"480\"><\/iframe><\/p>\n\n\n\n<p>I&#8217;ve discussed the formation of Texas so many times (<a href=\"\/blog\/?p=10453\">for example<\/a>) that I can&#8217;t stand to do it again. Let&#8217;s just say that Texas split from Mexico, became an independent nation, then joined the United States. Later the U.S. purchased a slice of Mexico that includes southern areas of modern Arizona and New Mexico, called the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Gadsden_Purchase\" target=\"_blank\" rel=\"noreferrer noopener\">Gadsden Purchase<\/a> (<a href=\"https:\/\/en.wikipedia.org\/wiki\/File:Gadsden_Purchase_Cities_ZP.svg\" target=\"_blank\" rel=\"noreferrer noopener\">map<\/a>). Are you still with me?<\/p>\n\n\n\n<p>OK, the Country Club Dispute revolved around the tiny 15-mile portion of border added between New Mexico (then a Territory) and Texas as a result of the purchase.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Bringing Suit<\/h3>\n\n\n\n<p>New Mexico became a state in 1912 and brought suit against Texas in 1913, disputing the border. The case went directly to the Supreme Court because it has original jurisdiction for all interstate disputes as provided in Article III, Section 2 of the U.S. Constitution. The Court appointed a &#8220;special master&#8221; who investigated the situation and filed a report. Ultimately this led to the Supreme Court case <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/275\/279\" target=\"_blank\" rel=\"noreferrer noopener\">New Mexico v. Texas<\/a> (1927).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">I&#8217;ll let Justice Sanford explain<\/h3>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;Each State thus asserted that the true boundary line is the middle of the channel of the Rio Grande in 1850. Neither alleged that there had been any change in this line by accretions. And the only issue was as to the true location of the channel in that year&#8230; That is, broadly speaking, New Mexico contends that the river then ran on the eastern side of the valley, and Texas, that it ran mainly on the western side. The distance between the two locations midway of the disputed area is about four miles.&#8221;<\/p><\/blockquote>\n\n\n\n<p>The Franklin Mountains run along the eastern side. A slight rise in elevation occurs within the terrain to the west. The Rio Grande has a history of sloshing between those two natural barriers. As Justice Sanford noted, those sit about four miles apart. Both sides agreed that the border should follow the path of the Rio Grande as it existed in 1850. That wasn&#8217;t in dispute. The precise <em>location<\/em> of the river in 1850 was in fact the dispute.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Evidence<\/h2>\n\n\n\n<p>New Mexico relied upon witness evidence of dubious precision. The Court used terminology now considered unfortunate &#8212; there&#8217;s mention of illiterate Indians and Mexicans &#8212; to make a larger point. Witnesses relied upon imprecise memories of events occurring more than fifty or sixty years earlier. Meanwhile, Texas relied upon &#8220;<em>the Salazar-Diaz Survey of 1852, the Texas surveys of 1849 and 1860, the maps of the surveys made in 1852-1855 for the Joint Boundary commissions, and the Clark map of 1859<\/em>.&#8221;<\/p>\n\n\n\n<p>The Court dismissed New Mexico&#8217;s claim. The Rio Grande separates a corner of Texas from the rest of the state to this day. Similarly, it splits off small slices of New Mexico although to a much smaller degree.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Practical Exclaves<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/www.flickr.com\/photos\/visitelpaso\/17313556484\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" src=\"https:\/\/live.staticflickr.com\/8869\/17313556484_5d62becd75_b.jpg\" alt=\"Zin Valle FAM Tour. Photo by Visit El Paso; (CC BY 2.0)\"\/><\/a><\/figure>\n\n\n\n<p>The resolution of the dispute, tracing a riverbed that no longer existed, created a modern situation overflowing with all sorts of wonderful practical exclaves. I think my favorite example is the vineyard in Canutillo, Texas &#8220;<em>nestled between the majestic Franklin Mountains and the high plains where the Rio Grande cuts a lush green valley through the desert creating the Mesilla Valley Appellation<\/em>&#8220;. <a href=\"https:\/\/www.zinvalle.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Zin Valle Vineyards<\/a> on Canutillo-La Union Road can be accessed only via New Mexico either from the north or the south (<a href=\"https:\/\/goo.gl\/maps\/FCUQqMHkufYLSRGM9\" target=\"_blank\" rel=\"noreferrer noopener\">map<\/a>).<\/p>\n\n\n\n<p>The same situation exists just to the east on Westside Road and several smaller lanes that emanate from it. The southernmost of the smaller lanes, Green Cove Drive, can be accessed from the outside world starting in New Mexico, driving into Texas, clipping New Mexico again, and ending in Texas (<a href=\"https:\/\/goo.gl\/maps\/cSmFfLVHhedGXDz46\">map<\/a>). Lucky residents.<\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">So why did they call it the Country Club Dispute?<\/h2>\n\n\n\n<p><iframe src=\"https:\/\/www.google.com\/maps\/embed?pb=!1m18!1m12!1m3!1d27115.558545569253!2d-106.60904696335993!3d31.840108881264985!2m3!1f0!2f0!3f0!3m2!1i1024!2i768!4f13.1!3m3!1m2!1s0x86ddf9a8d4aba909%3A0xa96e0fa4c091a0ad!2sEl%20Paso%20Country%20Club!5e0!3m2!1sen!2sus!4v1622633349226!5m2!1sen!2sus\" style=\"border:0;\" allowfullscreen=\"\" loading=\"lazy\" width=\"600\" height=\"450\"><\/iframe><\/p>\n\n\n\n<p>Because that&#8217;s where the <a href=\"https:\/\/www.elpasocountryclub.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">El Paso Country Club<\/a> established itself in 1906 (its current location dates to 1922). That, in turn, increased the desirability of the land which they sold in lots. Paradoxically the Country Club&#8217;s history page does not mention its prominent role in sparking an interstate dispute and a Supreme Court case.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Country Club Dispute came up from time-to-time in reader comments over the years.
